Applies to DentalCommunication, DentPlan3D, DentalMagic, PerioMaster, BotChat DentalMaster and Personal Assistant (all versions and editions), and to all other online tools, applications and services published by MDsimulation Ltd. under the DentalMaster brand.

1Who we are

These online tools are published by MDsimulation Ltd., operating under the DentalMaster brand. In this policy, “we”, “us” and “DentalMaster” refer to MDsimulation Ltd. “You” refers to the dental clinic, practitioner or organisation using our tools.

This policy covers the marketing communications we send, the personal data we process, the terms of the Free licence, and the limits of our liability. It applies alongside the Terms of Use and the Privacy Policy of each individual product.

2Tools covered by this policy

This policy applies to the DentalMaster tools listed below, in every edition, version, module and distribution channel — web, mobile, desktop, embedded widget or conversational interface — and to any future tool published by MDsimulation Ltd., unless that tool states otherwise in its own terms.

One rule applies to all of them, without exception

Unless expressly stated otherwise for a specific product or jurisdiction, these tools are not intended, marketed or certified as medical devices and are not intended to be used as standalone diagnostic software. Whatever the tool, whatever the module, and whatever it displays, records, charts, simulates, generates or suggests, its output is an informational and explanatory aid only. It is not intended to replace a diagnosis, treatment plan or clinical recommendation issued by a practitioner. Only an appropriately licensed or otherwise legally authorised dental practitioner, exercising independent professional judgement, may establish a diagnosis and issue the final treatment options or proposal to a patient.

This applies equally to any output produced automatically or with the assistance of artificial intelligence — conversational answers, suggested content, generated summaries, charts and simulations included. Such output must never be presented to a patient, or relied upon, as a clinical conclusion. It must be reviewed, validated and, where appropriate, corrected by the treating practitioner before it is used in patient communication or relied upon in connection with a clinical decision.

3Communications you will receive

When you create an account and accept our marketing consent, you agree to receive commercial and promotional communications from DentalMaster by email and by SMS.

We typically send only a limited number of marketing messages each month. SMS is reserved for short, time-sensitive messages.

Separately from the above, we will always send you service messages — password resets, security notices, licence expiry, essential technical information. These are not marketing and are not covered by the consent below: they are necessary to operate your account and cannot be opted out of while your account is active.

5The Free licence

Several of our tools — including DentalCommunication and Personal Assistant — are offered in a Free edition. The Free edition is provided at no cost, as a convenience, and on the terms set out below.

Where a tool is distributed in several versions differing by the volume of content included — as is the case for Personal Assistant, whose versions contain different quantities of videos and interactive 3D animations — the content available in a given version is the content actually published at the time of use. It is not a fixed catalogue: titles may be added, replaced or withdrawn.

We may end the Free edition at any time

We may suspend, restrict, modify or terminate the Free edition — for all users or for any individual user — at any time, at our discretion, and without prior notice. We are not required to give a reason. The Free edition is supplied free of charge and “as is”: no compensation, refund or indemnity of any kind is due, on any basis, as a result of its modification, suspension or termination.

This paragraph applies to the fullest extent permitted by applicable law. Where a mandatory rule of law grants you a right that cannot lawfully be excluded, that rule prevails over this paragraph — and only to that extent.

This includes, without limitation, the right to:

  • change the limits of the Free edition (number of films, videos, 3D animations, documents, charts, messages, requests or patients);
  • convert the Free edition into a paid plan, or discontinue it entirely;
  • close an individual Free account where we consider the service is being misused, resold, used contrary to these terms or to applicable law, or left inactive;
  • withdraw content, films or features previously available in the Free edition.

Where circumstances reasonably allow it, we will try to give notice and to leave you an opportunity to export your data — but we do not undertake to do so, and the absence of notice does not give rise to any claim.

The Free edition is provided “as is”, with no service-level commitment, no availability guarantee and no guarantee of data retention. If your use is important to your practice, use a paid plan.

Which wording prevails

If anything elsewhere in this policy, or in any of our marketing, documentation or support messages, appears to soften this section, the paragraph headed “We may end the Free edition at any time” prevails. Only a mandatory rule of law, or an express written commitment in a signed paid-plan contract, can take precedence over it.

6Personal data we process

As the account holder, we process the following about you and your clinic:

Retention

Account data is kept for as long as the account is active, then for the period required by applicable accounting and limitation rules. Marketing consent records are kept for the duration of the consent plus three years after its withdrawal, as proof that it was validly obtained.

Sharing

We do not sell your data and we do not rent our contact lists. We use a limited number of processors — hosting, email delivery, SMS delivery, video hosting — bound by contract to process data only on our instructions.

7Patient data

Our tools are built to hold as little patient information as possible. DentalCommunication does not require the clinic to enter the patient's name and is designed to minimise the patient information stored. A visit is identified by a reference of your choosing, a mobile number, and at most the last digits of a phone number or identity document, used solely to let the patient open their own content. Depending on the information selected or entered by the clinic, some data may nevertheless relate indirectly to a patient's treatment.

You remain the data controller for your patients

For everything relating to your patients, you are the controller and we act as processor. You decide what is recorded, what content is sent, to whom, and on what basis. It is your responsibility to inform your patients and to obtain any consent required under the law applicable to your practice.

Delivery logs — the frozen record of what was shown to a patient and when — are kept as a factual record. They are not intended to contain a clinical record and do not ordinarily include the patient's name. They may be retained independently of your subscription for evidential, security and dispute-resolution purposes, subject to applicable retention requirements.

8Cookies and similar technologies

Our own cookies are used primarily to operate and secure the service. We do not use our own advertising cookies to track you across unrelated websites, and we do not sell cookie data. Third-party embedded content may, however, use its own cookies as described below.

These are strictly necessary or functional cookies: without them the service does not work, so the banner does not ask you to consent to them. What the banner asks about is content from other services, described below. If we ever add analytics or advertising cookies, we will ask for your consent first and you will be able to refuse them.

On the patient side

Patient pages set no tracking cookie. Access to a visit works through a temporary token contained in the link you send, not through a cookie stored on the patient's phone.

Embedded third-party content is blocked until you agree

A video player, a reviews widget or a chat bubble can set its own cookies as soon as it loads. We therefore do not load that content at all until you have accepted it in the banner: in its place you see a notice with a button to load it. You can accept everything once, or load a single item without changing your choice. Those providers' cookies are governed by their own policies, not by ours.

If you embed a third-party widget in your clinic profile, it is still your responsibility to inform your patients that it exists.

Changing your mind

Your choice is recorded for six months. You can reopen the banner and change it at any time from the accessibility button at the bottom of the screen, under Cookie settings.

Controlling cookies

Every browser lets you view, block or delete cookies. Be aware of the consequences: blocking the language cookie means the interface resets to its default language on every visit, and blocking the authentication cookie prevents you from signing in at all.

9Your rights

Depending on where you are established, you may have the right to access, rectify, erase or export your personal data, to object to its processing, or to restrict it. You may also lodge a complaint with your national supervisory authority.

To exercise any of these rights, write to privacy@identalmaster.com. We reply within thirty days. We may ask you to confirm your identity before acting on a request.

The user acknowledges that the online tools published by DentalMaster — including, without limitation, DentalCommunication, DentPlan3D, DentalMagic, PerioMaster, BotChat DentalMaster and Personal Assistant, in all their versions — unless expressly stated otherwise for a specific product or jurisdiction, are not intended, marketed or certified as medical devices and are not intended to be used as standalone diagnostic software. The user is granted access to the software in its current version as published online and uses it under their own professional responsibility, within its stated intended purpose and subject to the review obligations described in this policy.

Our tools are aids to communication, visualisation, recording and education. They do not establish a diagnosis, do not propose a treatment plan and do not replace the clinical judgement of a qualified practitioner. Any simulation, illustration, chart, film, 3D animation, measurement, generated text or conversational answer is intended to explain — it is never a prediction of a clinical result, nor a promise of outcome.

Only a certified practitioner decides

The diagnosis, treatment options and final proposal presented to a patient may be established and issued only by an appropriately licensed or otherwise legally authorised dental practitioner, acting within their scope of practice and under the law applicable to them. No output of any DentalMaster tool may substitute for that decision, be presented to a patient as a clinical conclusion, or be used to justify the absence of a clinical examination, of a professional assessment, or of properly informed patient consent.

The practitioner remains solely responsible for the diagnosis, the treatment plan, the information given to the patient and the consent obtained from the patient. The content recorded, selected, generated, validated and sent through our tools is chosen by the practitioner, under their own responsibility.

Charts, measurements and recorded data

Where a tool records, charts or displays clinical data — such as periodontal readings in PerioMaster — it acts as a recording and presentation instrument. It does not verify, interpret or validate what is entered. The accuracy, completeness and clinical interpretation of that data remain entirely the responsibility of the practitioner who records it. Any indicator, colour code, score or summary displayed is a reading aid, not a clinical finding.

Video libraries and 3D animations

Where a tool provides a library of videos or interactive 3D animations — such as Personal Assistant, in any of its versions, or the system films of DentalCommunication — that content is generic, illustrative and educational. It shows a treatment in general terms; it does not represent the patient's own anatomy, their own case or their own expected result, and it is not a prediction of outcome.

The practitioner decides which title is shown to which patient, and is responsible for that choice and for the explanation given alongside it. Showing an animation to a patient does not replace the clinical explanation, nor the informed consent that must be obtained.

Automated and AI-assisted output

Where a tool produces an automated or AI-assisted answer — such as BotChat DentalMaster — that answer is general information and organisational assistance only. It may be incomplete or incorrect, it is not personalised medical advice, and it must never be relied upon for a clinical decision without review by the treating practitioner. Such a tool does not triage, does not assess urgency, and is not a means of obtaining medical help. In an emergency, contact a practitioner or the emergency services directly.

DentalMaster makes no warranty, express or implied, as to the fitness of these tools for any particular purpose, nor as to their accuracy, completeness or continuous availability, except for any express commitment stated in an applicable paid-plan contract.

11Limitation of liability

To the fullest extent permitted by applicable law, DentalMaster is not liable for indirect, incidental, special or consequential damage, or for damage arising from misuse, use outside the stated intended purpose, reliance on unreviewed output, or a clinical decision made by the user. This includes, without limitation, loss of profit, loss of opportunity and harm to reputation. Nothing in this paragraph limits any express obligation accepted by DentalMaster in a paid-plan contract.

In particular, DentalMaster is not liable for any diagnosis, treatment plan, clinical decision, proposal made to a patient or patient outcome — all of which fall within the exclusive responsibility of the certified practitioner.

Nothing in this policy excludes or limits liability which cannot lawfully be excluded or limited, in particular in cases of fraud, wilful misconduct or personal injury.

Where liability is established and may lawfully be limited, the following is our entire liability and your sole and exclusive remedy:

Free editions Supplied free of charge and “as is”. No refund, compensation or indemnity is due, on any basis — including where the edition is modified, suspended or discontinued.
Paid licences A refund of the unused portion of the fee already paid for the licence then in force, calculated pro rata over the remaining term from the date of the event. No other sum is due, and the total can never exceed the fee paid for that licence term.

No other remedy is available — no replacement, no re-performance, no damages and no indemnity beyond the amount set out above.

12Accessibility

We want our tools to be usable by practitioners and patients whatever their abilities, and we work towards the WCAG 2.1 level AA criteria. We state this as an objective, not as a certification: no independent accessibility audit has been carried out to date, so we do not claim formal conformance.

What is in place today

  • Navigation and all actions reachable with the keyboard, with a visible focus indicator.
  • Text contrast checked against the AA threshold on the main interface.
  • Semantic headings, labelled form fields, and alternative text on informative images.
  • Layout that adapts to zoom and to small screens without loss of content.
  • Motion reduced automatically when the operating system requests it.
  • An accessibility button on every page: larger text (three levels), bolder text, underlined links and reduced animations. Those preferences are stored locally on your own device — they are a functional setting, never sent to us and never used to identify you.
  • Full right-to-left support for Hebrew and Arabic, and an interface available in ten languages — language being, in practice, one of the most common accessibility barriers in a clinic.

Known limits

  • Embedded third-party content — video players, reviews widgets, chat bubbles — is outside our control and may not meet the same criteria.
  • Some older screens have not yet been reviewed against these criteria.
  • PDF documents uploaded by a clinic are that clinic's own files; we do not alter them and cannot guarantee their accessibility.

Telling us about a problem

If a page or a function is not usable for you, write to info@identalmaster.com, giving the page concerned and what blocked you. We reply within thirty days. Where a screen or a document cannot be made accessible quickly, we will provide the information in another form.

13Support

We welcome any feedback on our online tools and we read it. However, we are under no obligation to provide support of a technical, medical or any other nature, and in particular none whatsoever in respect of the Free edition.

Support commitments, where they exist, are those set out in the contract of a paid plan. The absence of a reply to a request does not constitute an acknowledgement, a commitment or a fault. In no case does a reply from our support team constitute clinical advice.

14Changes to this policy

We may amend this policy at any time. The version in force is the one published on this page, with its effective date shown at the top. Material changes affecting your rights will be notified by email to the address registered on your account.

Where permitted by applicable law, continuing to use our tools after a change has been published constitutes acceptance of the amended policy. Where separate consent or express acceptance is legally required, we will request it.
